According to Organic Law 3/2018the requirements established in this regard (art. 20.1), is that the data refer “to certain, overdue and payable debts and that the creditor has informed the affected party in the contract or at the time of requesting payment about the possibility of inclusion in said systems.
In Spain there is three main delinquent files: ASNEF, CIRBE and RAI. Each of them requires a series of documentation to be able to access their databases and check if we are part of them. You can request access on their web pages:
Bank of Spain (CIRBE)
The Bank of Spain collects the data within the Risk Information Center. You can enter the Electronic Office of the Bank of Spain and request your report via the web by accessing the application «Request for reports and CIR Claims» available in the “Processing” section.
It is essential to have a digital signature or electronic certificate issued by Certification Service Providers (PSC) admitted by the Bank of Spain (electronic DNI, electronic signature, etc.). You will have to enter some additional data to the ones you will obtain from your digital certificate, such as your date of birth, email in which to inform you of the status of your application and your old NIE, if any.
Once the process is done, all you have to do is wait. Generally, they usually take about 15-30 minutes and they inform you by email when they have said report.

List of ASNEF defaulters
The ASNEF File is a database of non-compliance with monetary obligations owned by the National Association of Financial Credit Establishments operated by ASNEF-Equifax and managed by Equifax, which feeds on the information provided by the associated members and adhered to the Association.
In the case of ASNEF, they request personal data such as the DNI or CIF, the postal address, and the documentation regarding the debt. To check if you are in ASNEF, you will have to fill in This formulary with the following information: full name, personal identification number (DNI or NIE), email address and postal address.
Once you have completed the form, you will have to send it by mail to email@example.com or to the following postal address: Apartado de Correos 10.546, 28080, Madrid.
If you have received a letter from ASNEF, the process is simplified, since you will only have to this link and enter your DNI and the reference number that has been provided to you in said letter to check if you are on this list of defaulters or not.
RAI delinquent file
On the other hand, to find out if you are on a RAI list, with the CIF and completing a web application form, it will be enough. The Record of Unpaid Acceptances It is a register of defaulters that includes information on non-payment of doubts equal to or greater than 300 euros by legal entities.
In the RAI, the response is quick, but it is necessary to pay the cost associated with being able to carry out the query, in addition to being registered in the service. The consultation of these lists, with the exception of the RAI, for the interested parties themselves is free, since they would be exercising the right of access to the personal data that the delinquent file has about us. The RAI is excluded from these rights, because it only includes legal entities.
